The Court of Appeal has thrown out an application by Nana Appiah Mensah, popularly known as NAM1, the Chief Executive Officer of the now-defunct Menzgold Ghana Limited, seeking to halt his ongoing criminal proceedings.
NAM1 had filed the application in an effort to pause his trial while awaiting the outcome of an appeal challenging a decision by the High Court. That earlier ruling required him to open his defence in a case where he faces numerous charges, including selling gold without a license, defrauding by false pretences, fraudulent breach of trust, and money laundering.
Following the High Court’s directive in 2024, NAM1’s legal team proceeded to the Court of Appeal, not only contesting the order but also filing a motion to stay the High Court proceedings pending the appeal’s outcome.
However, on Monday, May 19, 2025, state prosecutors urged the appellate court to dismiss the request. They argued that the application sought to stretch the authority of the court and failed to demonstrate any exceptional grounds to justify suspending the ongoing trial.
The three-member panel of justices—presided over by Justice Gbiel Suurbaareh and assisted by Justices Afia Serwaa Asare-Botwe and Christopher Archer—unanimously rejected the application.
Reacting to the decision, Frederick Forson, a spokesperson for Menzgold’s aggrieved customers, praised the court’s ruling. “It is a step toward justice,” he said, expressing optimism that the trial will bring some closure to the victims.
Meanwhile, NAM1 has signaled that he may escalate the matter to the Supreme Court, acting on legal advice from his counsel.
